Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and GETQCALL (“Company”, “we”, “us”, “our”) regarding your access to and use of our websites, apps, dashboards, APIs and related services (collectively, the “Service”). By creating an account, scanning or generating QR codes, or otherwise using the Service, you agree to these Terms.

Accounts & Eligibility

  • You must be at least 18 and capable of entering into a contract.
  • You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
  • You must provide accurate registration details and keep them up to date.

Subscriptions & Features

  • Paid plans provide access to specific features (e.g., dynamic links, analytics, location-restricted scans, multi-user access).
  • We may add, change or remove features with reasonable notice. Material changes will be communicated to the account owner email.

Your Content

  • You retain all rights to content you upload or link via QR codes (“Customer Content”).
  • You grant us a limited, non-exclusive license to host, process and display Customer Content solely to provide the Service.
  • You are responsible for ensuring Customer Content and destinations comply with laws and these Terms.

Acceptable Use

You may not use the Service to distribute malware, phishing, hate speech, illegal products, IP-infringing materials, or content that violates privacy or consumer protection laws. Automated scanning or scraping that degrades the Service is prohibited.

Service Availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be scheduled, and urgent security updates may occur without notice.

Termination

You may cancel at any time from your dashboard. We may suspend or terminate accounts for material breach, abusive behavior, or legal risk. Upon termination, your access to premium features ends and QR destinations may be disabled.

Disclaimers & Liability

The Service is provided “as is” without warranties of merchantability, fitness for a particular purpose or non-infringement. To the maximum extent permitted by law, our aggregate liability for all claims in any 12-month period is limited to the fees paid to us for the Service during that period.

Governing Law

These Terms are governed by the laws of [jurisdiction], excluding its conflict of law rules. Venue shall be the courts of [city/province].

Cookie Policy

We use essential cookies to keep you signed in and remember preferences, and optional analytics cookies to improve the Service.

  • Essential: authentication, security, load balancing.
  • Analytics (optional): usage trends, performance metrics.

Acceptable Use Policy

  • No illegal content, IP infringement, or violations of privacy/consumer laws.
  • No phishing, spam, scams, or harmful destinations.
  • No bypassing security, probing infrastructure, or overloading the Service.
  • Respect location-based restrictions if you enable geofencing features.

Refunds & Billing

  • Subscriptions renew automatically unless cancelled before the renewal date.
  • We offer a [e.g., 14-day] refund window for first-time purchases if the Service materially fails to perform as described.
  • Refunds are not available for partial billing periods after renewal.
  • Invoices and VAT/GST details are available in the billing portal.

Data Processing & GDPR

For customers subject to GDPR/UK GDPR, GETQCALL acts as a data processor for Customer Content and a controller for account/operational data. Our DPA, including Standard Contractual Clauses where applicable, is available upon request.

Security

  • Encrypted transport (HTTPS/TLS) and encryption at rest for sensitive data.
  • Role-based access control and activity logs for admin actions.
  • Regular backups, monitoring, and vulnerability management.
  • Responsible disclosure program: report issues to support@getqcall.com.
